The artwork that's featured in Gaga's 2011 album Born This Way was brought to the courts by French artist, Orlan.
Lady Gaga's anthem Born This Way is a visual extravaganza.
However, the artist Orlan took issue with Gaga's second studio album and it's artwork, claiming that Gaga and her creative team had plagiarized the concepts from two sculptures; Bumpload (1989) and Woman With Head (1996). The artist argued that both of her works had been used in the album artwork and in particular, the visuals for the 'Born This Way' music video.
Orlan was seeking 7.5% of the royalties acquired by Born This Way. Toted up, that would be a neat sum of around €29 million. According to The Art Newspaper, Orlan has failed in her court pursuit. The court ruled that an artistic installation cannot be reduced solely to its physical elements. Just to run salt into Orlan's wound, the court also ruled that Orlan must pay Gaga and her record label €10,000 each, due to France's legal proceedings.
Orlan commented that she fully intends to appeal the court's decision.
