The offending song in question is Sheeran's Grammy Award winning Thinking Out Loud.

In 2014, Thinking Out Loud peaked at Number One in the UK and Number Two in the US, scooping up two Grammy awards for Sheeran in the process. The copyright motion was filed by the heirs of Ed Townsend who co-wrote the song with Marvin Gaye. They claim that Sheeran's song is based on the harmonic and rhythmic progressions of the classic hit.

It is not the first time Sheeran has been sued for copying other songs. In 2014, the songwriters behind X Factor winner Matt Cardle's successful single Amazing accused Sheeran of copying their song in his smashhit Photograph.

Last year, Gaye's family successfully sued Pharrell Williams for copyright in his hit Blurred Lines.

Pharrell and partner in crime Robert Thicke were forced to pay Gaye's children $7.4m.
